Aaron Phypers accuses Denise Richards of failing to formalise daughter's adoption

Aaron Phypers has claimed Denise Richards never made his adoption of her daughter official.

The 52-year-old businessman filed for the divorce from the Wild Things star last month after six years of marriage, with their split growing increasingly acrimonious, and in his latest court filing, Aaron has alleged family harm.

In documents filed this week and obtained by People magazine, he claimed Denise, 54, had him sign adoption papers for 14-year-old Eloise, who he decribed as his "daughter by bond of over nine years", but "failed to file them".

Aaron alleged that since he filed for divorce, he has been left "legally without his daughter despite raising her as his own."

He added: "This has caused immeasurable harm and demonstrates the imbalance [Denise] maintains in this matter."

Aaron's comments came in a response to Denise - who adopted Eloise as a baby and also has Sami, 21, and Lola, 20, with ex-husband Charlie Sheen - after she asked a judge to order that he and his family vacate their home in Calabasas so she could retrieve her dogs and belongings without breeching the temporary restraining order they have in place.

In his response, Aaron said: "I do not oppose [Denise] retrieving her undisputed personal items and her mother's items, and ensuring the dogs' welfare, but I oppose any open-ended access or removal beyond an agreed, itemised list."

He offered three dates for her to get her items but "with conditions that protect both parties from conflict and prevent removal of disputed or community property."

And when Denise is retrieving her belongings, Aaron asked permission to be allowed to get his own "personal and business property" stored at the three townhouses his estranged wife lives in "concurrently or within the same court-ordered window."

 

He added: "These include personal belongings, office electronics, tools, furniture, files, books, gym equipment, a motorcycle, appliances (refrigerators, dishwasher), building materials (fasteners, wires, cabinets), computers, laptops, and generators.

"Several of these items are owned by third parties and merely loaned...prompt retrieval is essential to avoid loss, liability, or claims from the actual owners."

Aaron requested both he and Denise be off-site during retrieval, with only animal handlers and movers present, that they co-ordinate a pre-exchange list, electronics or data-bearing devices be absent, retrieval be done in a two-hour window between 9am and 5pm, that there's video documentation of entry and all removed items, as well as that disputed items stay pending stipulation or further order.

He argued Denise has withheld "office/trade equipment for more than 50 days" and currently has "sole control over marital funds"

He is seeking a contribution from the former Real Housewives star towards his $75,000 attorney fees, as well as an additional $140,500 "to address arrears" including seven months of past due rent.

Aaron has again denied his estranged wife's allegations that he "repeatedly abused" her during their marriage, and insisted he had "never physically harmed her", while he "has been the one deprived of property, income, and access to his child and family resources."

He also repeated his allegation that before their separation, Denise engaged in "infidelity and adultery during the marriage, despite prior assurances that the conduct would end."
