Kevin Costner files to dismiss sexual harassment lawsuit from 'Horizon' stunt double

Kevin Costner is filing to dismiss the sexual harassment lawsuit brought against him by Ella Hunt’s stunt double, who claims she was forced to act in a “violent, unscheduled rape scene” during one of the “Horizon” films.

Lawyers Marty Singer and T. Wayne Harman, who are representing the 70-year-old two-time Oscar winner, say that Devyn LaBella expressed “only enthusiasm and gratitude” when she wrapped on the unreleased second installment of “Horizon: An American Saga,” according to court documents obtained by TMZ.

“There was no anger or resentment,” said Singer and Harman, who included declarations from cast and crew countering the claims by LaBella. In his declaration, Costner decried LaBella’s accusations as “absolutely false” and “deeply disappointing.”

LaBella allegedly thanked a supervisor “for these wonderful weeks,” according to a text included in the filing.

“I so appreciate you! I learned so much and thank you again,” she continued. “I’m really happy it worked out the way it did too. Have a great rest of the shoot and yes talk soon!”

LaBella in late May sued the “Yellowstone” star and director for sexual discrimination, hostile work environment, sexual harassment, failure to remedy/prevent discrimination and harassment, retaliation, interference with the exercise of civil rights, intentional infliction of distress and breach of contract, per Variety at the time.

 

She claimed that the scene — acted alongside “6’2″, 220 lbs.” Roger Ivens — was added spontaneously, in violation of SAG-AFTRA, and “not within the scope of her role as a stunt double” though she “agreed to help.” She also alleged that there were no intimacy coordinators involved in the scene.

“Defendant Costner directed Mr. Ivens to repeatedly perform a violent simulated rape on Ms. LaBella,” she alleged.

Costner, for his part, says LaBella was fully clothed at the time and there was no nudity, nor rape or simulated sex or physical contact between the actors, according to TMZ.

Back in June, Costner’s lawyers similarly slammed the lawsuit as “meritless,” adding it had been “contradicted” by multiple witnesses.
